To apply for an international divorce, you or your partner must have a connection to the country. It is this connection that provides the foreign court with the jurisdiction to handle your case. It’s worth considering which court is likely to provide the best settlement for you. England and Wales generally begin divorce proceedings with a 50/50 split of matrimonial assets. This means both parties are likely to receive a fair settlement. However, if another country’s court is likely to serve your needs better, we can assist your application for an international divorce and represent your interests.

To apply for a divorce in England and Wales, you need to satisfy certain criteria. It’s important to understand the difference between your habitual residence and your domicile.

Habitual residence refers to the country you spend most of your time in and where your daily activities tend to take place. If you work abroad in multiple countries and own multiple properties, this is not always clear cut.

Your domicile is a more specific legal term and is automatically assigned at birth depending on where your father was born. Your ‘domicile of origin’ can change to a ‘domicile of choice’ by moving to another country and cutting all connections to the previous one.

To work out whether you should apply for a divorce in England and Wales or another country, consider whether one of the following criteria applies. If it doesn’t, courts in England and Wales will not have the jurisdiction to handle your case.

  • You and your spouse are habitually resident in England or Wales
  • The respondent is habitually resident
  • You were both habitually resident and one of you still lives here
  • You are habitually resident and have been for 12 months
  • You are domiciled in England and Wales and have lived here for 6 months
  • You are both domiciled in England or Wales
